Ulusal ve uluslararası ticari uçuşların ve yolcuların sayısı gün geçtikçe artmakta bu da ortaya yeni hukuki sorunlar çıkarmaktadır. Bu sorunlardan biri de herhangi bir ticari uçuşta meydana gelebilecek olan tıbbi acil durumlarda uçuş firmasıyla hiçbir ilgisi olmayan yolcu doktorun olaya müdahale yükümlülüğü olup olmadığı ve bu müdahaleden doğacak tazmin ve cezai sorumlulukları çerçevesinde gelişmektedir. Ulusal ve uluslararası haberlerde karşımıza çıkan film ve dizelere de konu yapılan “uçakta doktor var mı?” sorusunun akabinde yaşanacak olanlardan gönüllü doktorun herhangi bir cezai sorumluluğu olup olmayacağı bu hususta karşılaştırmalı hukukta yahut ülkemiz hukukunda mevcut yasal düzenlemelerin olup olmadığı işbu makalemizin konusunu oluşturmaktadır. Tahmin edilebileceği üzere durumun uluslararası niteliği de uygulanacak mevzuatın belirlenmesini zorlaştırmakta ve sorunu daha da derinleştirmektedir. Bu bağlamda makalemiz, ilk bölümde önce sorunu ve soruna ilişkin tanımlamaları ortaya koyacak olup, ikinci bölümde ise karşılaştırmalı hukukta ve ülke hukukumuzda mevcut yasal düzenlemelerin üzerinde durulacaktır. Son bölümdeyse, mevcut durumun iyileştirilmesine yönelik çözüm önerileri verilecektir.
The number of national and international commercial flights and passengers is increasing day by day, which creates new legal problems. One of these problems is whether the passenger doctor, who has nothing to do with the flight company, has an obligation to intervene in medical emergencies that may occur on a commercial flight, and the indemnification and criminal liabilities arising from this intervention. The subject of this article is whether the volunteer doctor will have any criminal liability for what will happen after the question “Is there a doctor on the plane?”, which is the subject of national and international news, movies and TV series, and whether there are existing legal regulations in comparative law or in the Turkish law. As can be expected, the international nature of the situation makes it difficult to determine the applicable legislation and deepens the problem. In this context, in the first part of the article, we will first present the problem and the definitions related to the problem, and in the second part, we will focus on the existing legal regulations in comparative law and in the Turkish law. In the last part, solution suggestions will be given to improve the current situation.
